•attempts to communicate with child discouraged/forbidden; Messages from Bio to me, mom & sarah re child thought it best to not communicate with me or my mom in order to “get [her] life together”

MEDICAL

*Child withheld from required neurological and spine medical specialist appointments for surgeries performed when 12 y.o.

•now receives monthly $ for 75% physical disability

EDUCATION

*Child withheld from basic education

•previously attended freshman year of high school at The Center School at Seattle Center

•not allowed to attend public high school while 3 other children in home freely left residence to attend public school

•enrollment in distance learning course for high school level (9th grade) she had already completed - wifi kept from her so she couldn't complete work

•grandfather in Fairbanks ordered new router from distance learning school- shipping interference from bio so router not received

*ABUSE/NEGLECT

•cigarettes & chip all ice off porch

•no privacy in male dominant home - door taken off hinges and totally removed - wouldn't let her hang a blanket in doorway

•no food - lost large amounts of weight at a time

•only 2 pairs underwear entire time

•asked for and denied single disposable razor

•no shampoo/conditioner

•emotional abuse - kept home while others went to school, left out of fast food/restaurant trips, shopping trips, intentionally avoided buying food she liked

•nailed window shut

•physically tore door down in a rage

•not allowed to physically leave home - no fresh air, exercise, light sensitivity in eyes while at grandfather's home after being "kicked out"

•regular name calling; ugly, stupid, freeloader, severe derogatory remarks regularly made about mother, abusive remarks about chosen gender roles and refusal to respect them

•anxiety so severe Afraid to leave room to use bathroom

•anxiety so severe stopped leaving room to try and get food; lost 15 pounds in 1 week

•anxiety so child refused to allow me to have food delivered to her by a restaurant or food bank, she was too afraid to leave home and meet a delivery person and return with anything that would potentially cause confrontation

*person claiming support owed actually still owes me

•past due balance over $5k when then-child coerced to Fairbanks to "give him a chance"

•tax return garnished while on the street, $1,000 would have changed my life

•if i did/do owe, support amount indicated as due is miscalculated and totals over $12k for 2 years

•child not in physical custody, care, or responsibility whatsoever from last week of June 2017 until February 2, 2018. Support should not be owed to him as he wasn't supporting the child who was out of his home

•child didn't arrive in Fairbanks until May 20

*kk committed until 18, no longer in his physical custody, after attempt to remove her from grandfather home in Fairbanks after kicking her out

•Fairbanks troopers contacted

•troopers brought her to Fairbanks hospital

•hospital transfer to North Star via WEKA med transport

*he fraudulently took and used her adult-claimed state benefits (food card) even though she was not in his home

A. Initial Custody Order Issued at Anchorage in 2004

Ms. Teressa (Tess) Fauver-Hernandez and defendant appeared at Anchorage Superior Court for a divorce trial in 2003. The petitioner's filing had been contested by defendant with his demand for sole custody of their only child, Krystin Gardiner (n/k/a Krystin Fauver, DOB: 02/02/2002).

Uncontradicted trial testimony revealed Jerry had perpetrated severe physical abuse on the Plaintiff and that he had knowingly jeopardized Krystin’s safety. ​ Id.​, ​p. 6. Primary physical and sole legal custody was awarded to the plaintiff and defendant was ordered professionally supervised visits 1x/week for up to two hours. Id. §​ 3. The court further set forth limitations on the father's interactions with his daughter to help keep the child safe until the defendant addressed his unsafe behavior patterns with enrollment and completion of a length dv prevention course and multiple parenting classes.

B. Initial Custody/Decree Affirmed, Plaintiff & Child Relocate to Washington

Ms. Fauver filed for custody modification, a request to the court to move; order granted and language was added that allowed Ms. Fauver and Krystin to move out of state, no other changes made to original decree

C. Defendant Failed to Remedy Violent Behavior & Lack of Parenting Skills

There has never been evidence that Mr. Gardiner made any effort to address his reckless and abusive actions; not even in the minimal amount necessary to fulfill his legal obligations.

D. Defendant Failed to Establish a Parent-Child Relationship

13 years went by without a direct or indirect request from the defendant to discuss a visitation with daughter, telephonically or otherwise. Krystin underwent 2 major surgeries and spent an entire summer of her childhood as a hospital inpatient. Ex. ______ Her inpatient status meant she didn't leave the hospital for even a minute that summer, and every moment until her surgery was spent with the heavy iron 'halo' used in halo traction bolted into the crown of her skull. Over the summer, her spine was manually lengthened in preparation for her upcoming surgery, and over 1/3 of her body weight hung from her halo in the form of iron plates. Id. at p. ____ She had no appetite because she constantly in pain. Though naturally slender, she still lost a notable amount of bodyweight, and her thin frame was lifted from her wheelchair by the iron plates connected to her skull so that her bottom no longer touched the seat of her wheelchair. She cried in bed every night, constantly attached to the iron plates that pulled her spine past its natural limit.
