Excerpts from "Petitioner’s First Amended Reply," a document authored by me, "Petitioner," in October - November, 2020.
Respondent = secret court code word for Muntmin (or, "Max")
Respondent’s sworn statements are often in conflict with the sworn statements submitted by other persons - statements that were filed by respondent - in attempt to support his claims. Further, multiple assertions made in his most recently filed written testimony conflict with statements he previously swore to be fact in this matter.
1. Respondent alleges I “disappeared,” but testimony & exhibits offer full proof that the allegation is false.
At page 1 paragraph 2 of respondent’s declaration, he claims that I disappeared from the lives of himself and my son for 7 months, from mid-July, 2019 (about the time his parents requested I move out) to February, 2020.
However, at page 5, paragraph 32, respondent shares memories of his arrest on August 21, 2019 for DV assault and DV theft committed against me.
Further, respondent’s Exhibit A5 is what appears to be a copy of pieced-together emails (not originally part of a singular string of messages) that are supposed to look like they began with an email from me to respondent on September 6, 2019. I’m baffled at this effort. Respondent indicated that the emails he used as exhibits were provided as evidence that he had been contacting me with no response, and proof that I had ‘disappeared’ from July 2019 to February 2020.
The first 2 of the 3 pages are undeniable evidence of the defendant’s intentional violations of the previous no-contact order between us as imposed by the City after the DV arrest in August. The matter, and the related no- contact order, weren’t dismissed until February 27, 2020. Ex. ___.
Additionally, I am in possession of texts that bring to the record accurate transcripts of text messages exchanged between respondent and I as evidence of our steady communication until his arrest on August 21, 2019. I continued to attempt communication with him because I was receiving no response and wanted to make further arrangements to spend real time with Haven. I was never served with a copy of the 2-year no-contact order put into place by the city, but gives reason to the fact that respondent was the one that actually “disappeared,”and not me, as he insists.
Our text communications pick up again in November, 2019 and continue through part of December, until I lost my cell phone. I was without a phone from around mid-December, 2019 until approximately March, 2020.
